1. Purpose
These Terms & Conditions govern access to and use of the Kiwii service, a SaaS time-tracking platform for businesses, available at kiwiiapp.com. By creating an account or using the service, you accept these terms in full.
2. Access to the service
To use Kiwii you must create a company account with accurate information. The account holder is responsible for keeping their credentials confidential and for all activity carried out under their account.
3. Trial period
All plans include a free trial period of 14 days from activation, with no need to provide credit card details. Once that period ends, the service is automatically suspended unless a paid plan is taken out.
4. Plans and pricing
The current prices are:
- Starter: USD 29.90/month + VAT — up to 1 site and 10 employees.
- Pro: USD 39.90/month + VAT — up to 3 sites and 30 employees.
- Enterprise: custom pricing based on volume and requirements.
All prices are billed monthly in advance. Payments are processed by Stripe. We reserve the right to change prices with at least 30 days' notice by email.
5. Cancellation
You may cancel your subscription at any time from the billing portal or by contacting us. Cancellation takes effect at the end of the current billing period. No pro-rata refunds are given for partial months.
6. Acceptable use
You undertake to use the service only for lawful purposes and in accordance with applicable labour regulations. The following is prohibited:
- Tampering with or falsifying time-tracking records.
- Sharing access credentials with unauthorised third parties.
- Attempting to access data from other accounts or carrying out penetration testing without express authorisation.
- Using the service for illegal or fraudulent activities.
7. Data and privacy
The processing of personal data is governed by our Privacy Policy. You are responsible for obtaining your employees' consent for recording their working hours in accordance with article 20 bis of the Spanish Workers' Statute.
7 bis. Processing by Artificial Intelligence
Certain features (automatic data extraction from invoices and delivery notes, QR catalogue translation, generation of training content) process the documents you upload through Anthropic, Inc. (provider of the Claude language model). Anthropic acts as a data processor under a data processing agreement (DPA) with a zero data retention policy: the data sent is not used for training and is not stored after the response. You can disable AI processing at any time from /admin/configuracion. If you disable it, the OCR and translation features will stop extracting data automatically; you will still be able to upload documents but will have to fill in the fields manually.
8. Availability and SLA
We commit to a monthly service availability of 99.5% for the Starter and Pro plans. The Enterprise plan includes a custom SLA. We are not liable for interruptions caused by third parties (WhatsApp, Stripe, connectivity providers) or by force majeure.
9. Limitation of liability
In no event shall our total liability for damages arising from use of the service exceed the amount paid by the customer over the last 3 months. We are not liable for labour penalties arising from incorrect use of the system by the customer.
10. Amendments
We may update these terms at any time. Material changes will be communicated at least 15 days in advance by email. Continued use of the service after that date constitutes acceptance of the new terms.
11. Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of Málaga, waiving any other jurisdiction that may apply to them.
